You must be at least 18 and able to enter into an agreement to use the service. If you act for a business, you must have permission to do so. Provide accurate information, keep your account secure, and promptly report suspected unauthorized use to support@surplus.com.
Use only marketplace accounts and content you are authorized to access. Do not misuse the service, interfere with others, bypass access restrictions, submit unlawful content, or use Surplus to send unwanted messages.
What Sam can do
Sam helps organize information, answer questions, and support available marketplace and listing workflows. Features vary by account, marketplace, and stage of release. A saved login does not establish a successful connection, and a connection does not guarantee complete or current activity history.
Summaries and drafts can contain mistakes or missing information. Review source listings and seller documents before relying on price, condition, ownership, title, deadlines, pickup instructions, or other material details. An observed vehicle or equipment start does not establish included keys, roadworthiness, or overall condition.
The initial external-marketplace service monitors authorized account activity. It does not submit bids, offers, purchases, or payments for you. Any future transaction feature would require its own disclosed permissions and terms. Monitoring frequency is a target, not a guarantee; auctions can be extended and source information can change.
Marketplaces, listings, and transactions
Independent marketplaces and sellers set their own auction rules, fees, payment terms, and pickup obligations. Their terms govern transactions on their platforms. Surplus is not responsible for their availability, listings, or performance and does not guarantee that you will win an auction or receive an alert before it closes.
If you create a listing, you are responsible for the accuracy of the final listing and for having authority to sell the item. You retain your rights in uploaded content and give Surplus permission to store, process, and display it as needed to provide the service and publish the listing you approve. Review drafts before publishing. Additional sale or payment terms, if applicable, will be presented in the relevant workflow.
Surplus Sam text messaging terms
Surplus Sam is operated by Surplus.com Corporation. By completing the optional SMS consent and phone-pairing flow, you agree to automated onboarding replies and the marketplace sign-in links you request. Consent is not a condition of purchase. Simply creating a Surplus account or providing a contact phone number does not enroll you in this program.
Message frequency varies. Message and data rates may apply. Future auction reminders, pickup reminders, or morning briefs require the applicable separate opt-in when offered. Onboarding consent does not enroll you in those features or promotional messaging.
Reply STOP to (610) 819-4640 to unsubscribe; you may receive a final confirmation. Reply HELP for help, email support@surplus.com, or call (610) 915-8840. START or UNSTOP removes a delivery block but does not reconnect an account. Complete fresh consent and pairing to reconnect. You must control the number you enroll and notify us if it is reassigned or no longer yours.
Delivery is not guaranteed. Carriers are not liable for delayed or undelivered messages. SMS is not an emergency service or a substitute for checking an auction, payment deadline, or pickup directly. See our Privacy policy for how we handle phone numbers, messages, and consent records.
Fees and availability
Any Surplus charges and payment terms will be disclosed before you agree to pay. Marketplace charges and carrier message/data charges are separate. These terms do not authorize undisclosed charges or enroll you in a paid subscription.
We may change, pause, or discontinue features, and may restrict access to protect users or address misuse. You may stop using the service at any time and contact support to close your account. Existing obligations from your marketplace transactions remain your responsibility.
Service limitations
To the extent permitted by law, the service is provided as available without warranties of uninterrupted operation, complete information, or fitness for a particular purpose. Surplus is not responsible for losses caused by inaccurate third-party information, unavailable marketplaces, or delayed alerts to the extent permitted by law. Nothing in these terms excludes rights or liability that cannot lawfully be excluded.
Pennsylvania law governs these terms except where applicable law requires otherwise. We may update these terms and will provide notice of material changes as appropriate. Changes do not remove rights you already have under applicable law.
